***MOMENTAMAX ULTRA OFFER – TERMS & CONDITIONS
The Momentamax Ultra Offer (the “Promotion”) is organised by MSD Animal Health UK Limited of Walton Manor, Walton, Milton Keynes, MK7 7AJ, UK a division of Merck & Co, Inc., Rahway, NJ, USA (“MSD AH”). The Promotion is void where prohibited by law. By participating in the Promotion, each entrant accepts and agrees to be bound by these terms and conditions (the “Terms and Conditions”).

The Promotion is:

During the Promotion Dates (defined below), buy 1 box of 20 doses of MSD AH’s new product, Mometamax Ultra (the "Paid Items"), and receive one additional box of 20 doses, free of charge (the "Promotional Items").

Promotion Dates: The Promotion will run from product launch until the earliest of either: (i) the 100th set of Promotional Items are given away; or (ii) until 5:00pm (BST) on 31 December 2023.

Eligibility: The Promotion is open to all non-corporate veterinary practices that are classified by MSD AH as either: (i) a buying group member; or (ii) an independent (with each such veterinary practice being an “Entrant”). The Promotion is applicable to the Great Britain only. Entrants must be legal residents of Great Britain at the time of participation and purchase through a MSD AH approved sales channel.

The Promotion is limited to one Promotional Item per Entrant. No third-parties may participate in the Promotion on an Entrant’s behalf. Each Entrant that receives any Promotional Items is not eligible to receive any further promotional offer in this Promotion. This Promotion cannot be combined with any other offer. This Promotion cannot be exchanged for cash.

Any decision of MSD AH regarding any aspect of the Promotion shall be final and binding. MSD AH reserves the right to hold, void, suspend, cancel, or amend the Promotion in any way at any time for any reason and may do so without the need to give notice to the customer.

Entrants are deemed to have accepted and agreed to be bound by these Terms and Conditions upon participation in the Promotion. MSD AH reserves the right to forgo the Terms & Conditions of the Promotion in any instances where Entrants have breached the Terms and Conditions.

Any attempt to deliberately damage any website or to undermine the legitimate operation of this Promotion is a violation of criminal and civil laws, and should such an attempt be made, MSD AH reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

MSD AH reserves the right at its sole discretion to disqualify any individual and/or Entrant that tampers with the entry process.

Refunds: If an Entrant is successful in the Promotion and subsequently seeks a refund for the Paid Items, the Paid Items must be returned together with the corresponding Promotional Items. If the Promotional Items are not returned together with the Paid Items for the purposes of a refund, the Entrant will be invoiced for the full retail price of the Promotional Items.

To the fullest extent permissible by law, MSD AH shall not be liable for data or information, damage to property, or any indirect or consequential loss howsoever arising whether from negligence, breach of contract or otherwise, arising in connection with this Promotion, except that nothing in these Terms and Conditions shall exclude MSD AH’s liability for:
(a) death or personal injury resulting from negligence;
(b) fraud or fraudulent misrepresentation; or
(c) any matter which it would be illegal for the Promoter to exclude or attempt to exclude its liability.

MSD AH is not responsible for any computer system, or technical malfunction of any telephone lines, computer on-line systems, software, hardware, servers, access providers, computer equipment, program malfunctions or other errors, failure of any entry to be received by MSD AH on account of technical problems or errors or traffic congestion on the Internet or at website, or any combination thereof, that are human or technical in nature, including any injury or damage to an Entrant’s or any other person's computer related to or resulting from playing or downloading any materials in this Promotion.

Personal Data: Personal data provided by Entrants in entering this Promotion will be processed by the MSD AH for the purpose of administering the offer. Participation in this Promotion will be deemed as an Entrant consenting to this processing. If an Entrant does not wish their personal data to be processed in this way, please do not complete the offer form. Personal data supplied during the course of this Promotion will only be processed as set out in the Privacy Notice provided at clause 12 below. MSD AH shall comply with Data Protection Law in connection with its obligations under these Terms and Conditions. For the purposes of this paragraph, “Data Protection Law” means any applicable data protection or privacy laws in connection with these Terms and Conditions.

The personal information (name, email address, job title, mobile number, business address) you provide will be processed for the purpose of processing your orders placed. By providing your details, you consent to the processing by MSD AH, acting as data controller. To process your personal information, MSD AH relies on the following legal basis: 1) contract; and 2) compliance with MSD AH’s legal obligations.

Consistent with the purposes described above, you acknowledge that the Personal Information you provide to MSD AH can be transferred to Merck & Co., Inc. (Rahway, NJ, USA), which operates as MSD outside of the U.S. and Canada; its subsidiaries and/or, its subsidiaries and/or to companies globally that provide services on our behalf, if that is required, and in accordance with applicable laws and our instructions. This may include international transfers in compliance with the Data Protection Act 2018 and General Data Protection Regulation 2018, using either our Binding Corporate Rules or Standard Contractual Clauses. Any party handling information on behalf of MSD is contractually obliged to process your personal information in accordance with the same privacy standards as MSD.

Retention period applied will be ten years. Information may be retained for longer if we have a legal or regulatory obligation or where we have a legitimate interest to do so.

You have certain rights to your personal information such as obtaining copies, correcting it or you can ask for it to be deleted. No term of these terms and conditions shall be enforceable under the Contracts (Rights of Third Parties) Act 1999 by a person who is not a party to these terms and conditions, but this does not affect any right or remedy of a third party which exists or is available apart from under that Act.

The offer shall be governed by the law of England & Wales, and Entrants irrevocably submit to the jurisdiction of the courts of England & Wales.
